Leno mistakenly believes that Prop 215 should limit the ability of employers to regulate their workplaces, but in fact the California Supreme Court upheld a lower court's ruling (Ross v. Ragingwire) that Prop 215 does not regulate the employment relationship. Prop 215 doesn’t include language that would allow marijuana smokers to attempt to regulate how an employer manages his business.
 The Court also ruled that the “Fair Employment and Housing Act” does not require employers to accommodate illegal drug use. It also reaffirmed an employers right to require job applicants to submit to a drug test.

The California Chamber of Commerce, an organization of businesses whose goal is to further the interests of businesses, was adamantly opposed to Proposition 19-marijuana legalization. “This initiative would change the way employers are required to do business in our state,” said Allan Zaremberg, President and CEO of the California Chamber of Commerce. “Essentially any employer would be required to offer marijuana users extra protections above those provided to other employees. If Proposition 19 becomes law, our state’s workers will face increased exposure to injuries and our employers will face increased exposure to liability.”

Although Leno’s introduction of SB129 may appear to be something new, it’s not, it’s the same legislation he introduced in 2007.

Keep in mind that Leno is fully aware of the abuse of "medical" marijuana, he knows that anyone can get a medical marijuana card from a list of unethical doctors willing to sell one for a fee. It isn’t about “medicine”, and it never was. This is solely about chipping away at our drug laws until he and other legalizers can force full marijuana legalization on the entire state.

Maybe it’s time for someone to tell Leno that voters emphatically rejected Prop19, and it’s time to move on, and just because legalizers were able to scam voters into approving Prop 215, doesn’t mean they're going to fall for another one.

Here's a message for Senator Mark Leno, you are a state employee which mean's your salary is paid by tax payers. You do not have my permission to violate my constitutional rights or your oath of office. Your anti business and anti constituional rights sentiment is not appreciated and possibly violates ethic laws.

Leno introduces SB129
SB129, would make it illegal for an employer to fire an employee for testing positive for marijuana. Leno calls SB129 “A medical marijuana employment rights bill”, but in actuality it eliminates an employers ability to provide a safe working environment.

This isn’t the first time Leno has attempted to undermine employers with legislation. In 2007 Leno introduced AB-2279. A bill that would have taken away an employers right to require employee’s to drug test. If a employee tested positive for marijuana use, the bill would have made it illegal for an employer to fire that person.
