On April 13th, the Governor of the State of Washington sent a letter to the Attorney General of the United States asking him for the Department of Justice's guidance on pending medi-pot legislation pending in his state.
In a letter from the U.S. Department of Justice sent late last week to Washington Governor Gregoire, federal prosecutors warn that federal law on marijuana cultivation and sale will be upheld regardless of state medi-pot laws.
Many policy experts believe the letter provides clear guidance to those who may have misinterpreted the Ogden Memorandum back in October of 2009, which stated that the government would not use its limited resources to arrest seriously ill patients using marijuana under the guise of medicine.
“There is definitely no room for misunderstanding now,” said Calvina Fay Executive Director of Drug Free America Foundation and Save Our Society From Drugs. “The Department of Justice will prosecute ‘medical’ marijuana programs to include dispensaries and sellers or growers of marijuana. If the state government is involved, such as when they regulate dispensaries or give out ‘medical’ marijuana cards, their employees will be subject to prosecution. I hope this much needed clarification helps other state legislators make a more informed decision when voting on medi-pot bills.”
